Description: | The underlying objective of the course is to provide the students with the opportunity to acquire the knowledge, skills and social competences related to the fundamental principles of the functioning of the internal market of the European Union and legal basis for undertaking and conducting business activity within the territory of the internal market. The syllabus also covers information concerning the influence of the European Union law on the development of domestic legal provisions of the respective Member States connected with running a business on their territories.
Legal issues discussed during throughout the course focus on the opportunities to undertake and conduct business activity on the territories of Member States of the European Union on the basis of the rights arising out of the fundamental freedoms of internal market. Particular attention is paid to the possibility to conduct business activity on the territory of another Member State of the European Union on a stable and continuous basis using the rights related to freedom of establishment and opportunities to provide cross – border services by entrepreneurs within the European Union on the basis of freedom to provide services. The issues analysed during the course are presented on the basis of the provisions of the Treaty on the Functioning of the European Union, provisions of the Directive 2006/123 on services in the internal market as well as on the basis of the relevant judgments of the Court of Justice of the European Union.
Furthermore, the course syllabus covers the opportunity to conduct business activity in the European Union in the form of supranational companies. In particular, the setting up and functioning of the European Economic Interest Groupings and the European Company (Societas Europaea) will be presented.
Students will also have be familiarized with basic provisions of Polish law concerning the principles of undertaking and conducting business activity by Polish and foreign entrepreneurs in Poland. |
