Purpose and description of the content of education: | The module is intended to equip students with basic knowledge regarding the activities provided for by law aimed at determining the liability of the accused for the offence he is charged with. In the course of teaching, students should be familiarized in particular with the principles governing the course of proceedings and determining the functioning of procedural bodies and other participants in criminal proceedings. The aim of teaching criminal procedure is also to provide elementary knowledge regarding civil law and procedure in the scope used in criminal proceedings (i.e. in the event of initiating a so-called additional process, pursuing claims for wrongful conviction, temporary arrest and detention). The effect of teaching is to provide students with the necessary theoretical knowledge and to provide information on the views formulated in doctrine and case law. Students should also be equipped with the ability to independently interpret procedural provisions that raise doubts. It is also necessary to develop competences to solve legal problems occurring in the context of the indicated factual situations. Teaching the ability to seek solutions for individual cases should be combined with attempts to prepare draft procedural decisions (including judgments resolving the issue of the accused’s criminal liability, decisions on discontinuing proceedings, orders to schedule a main hearing). |
