Description:
The course is intended to familiarize students with legal, economic, business and psychological aspects of business disputes. Students learn the details of mediation proceedings, including contacting the parties and the court. The syllabus covers legal and non-legal issues that may have a significant impact on the outcome of mediation proceedings. Also discussed are different techniques of conducting talks with parties, ways of seeking an optimum solution to a dispute that is acceptable for all.
Prerequisites:
Knowledge of the basics of civil law, economic law, economics and psychology.

Has an advanced knowledge of both judicial and non-judicial ways of settling international economic disputes. Knows and understands the role of ADR, in particular arbitration and mediation. Properly distinguishes the role of arbitrator and mediator. Knows the principles of constructing a compromise (court registration), arbitration agreements and arbitration clauses and the choice of applicable law. [MB_1]

Interactive classes making use of conversations and consultations, multimedia presentations, discussions of selected issues, individual and group solving of case studies, creating drafts of letters (including contracts) or completing them.

The student prepares documentation regarding mediation proceedings. During the dispute simulation, he or she is able to properly conduct it and propose an optimum solution.
