Description:
In the „Legal Reasoning” course syllabus, there are three basic components to be distinguished, with every consecutive component being more and more general in range. The first one, the most extensive, focuses on the legal interpretation as a basic skill essential to every lawyer. During the classes, every student is to be acquainted with notions of understanding and interpreting the law, with the particular interpretative tools and the assumptions about the hierarchy of these tools used both in theory and praxis. Students will get to know the different interpretative occurrences, allowing them to learn how to make the right choice about the interpretative tools depending on the situation. The second part concerns legal argumentation, more precisely – arguments used by lawyers that fall outside the area of interpretative arguments – legal topics, reasonings and collision rules. The ultimate part should be devoted to the application of law as a process during which both the interpretative and non-interpretative arguments are to be used. The goal of the class is to prepare the student to be a part of professional legal system, especially in the actions connected with the process od ajudication by both judges and public administration organs.
