Purpose and description of the content of education:
The curriculum of the module covers private international law in the strict sense. In addition to the general institutions of private international law such as characterization, renvoi, preliminary question, public policy clause, overriding mandatory provisions, evasion of law, change of applicable statute, application of the applicable law and related difficulties, the course also discusses conflict-of-law rules indicating the applicable law in matters of civil law, family law, and labor law. To the necessary extent, the course also addresses issues of international civil procedure (jurisdiction and the recognition and enforcement of foreign judgments) as well as matters related to the status of foreigners. The subject of analysis includes the conflict-of-law rules set out in the 2011 Act on Private International Law, in European law (Rome I and Rome II Regulations), and in selected conventions. The main teaching objective is to make students aware of the differences between substantive law and conflict-of-law rules and to help them grasp the principles of interpretation and application specific to private international law. Students should master the content of the above-mentioned regulations and the terminology characteristic of this field. Lectures should use real-life examples and references to both foreign and domestic case law. The use of visual schemes also facilitates understanding of the complex regulations of private international law. During the practical classes, students analyze case studies to learn the challenging art of categorizing situations involving a “foreign element” within the scope of relevant conflict-of-law norms. They also become familiar with tools related to the application of applicable law, such as characterization, adjustment, preliminary issue resolution, and develop legal reasoning, argumentation, decision-making, and justification skills. This course offers students the opportunity to recognize the diversity of solutions in various legal systems and teaches respect for legal differences found in other countries.
