Purpose and description of the content of education:
The module is designed to provide students with knowledge, competences and skills concerning the enforcement of civil claims of a cross-border nature, in particular claims arising between counterparties coming from different Member States of the European Union or claims resulting from a contract that was performed in another Member State. In the field of civil procedure, students will gain skills concerning access to courts and court procedures functioning in a given Member State for entities coming from other European Union countries. Students will learn about the uniform regulations in force at EU level in the field of specific civil proceedings, which allow a claim to be asserted in another Member State on the basis of universal norms rather than the norms in force in the internal legal system of the country concerned. In the part related to international cooperation in criminal matters, the module is supposed to enable students to become familiar with the rules on the performance of procedural acts by courts of a Member State other than the forum state, i.e. the state in which criminal proceedings are conducted. At the end of the module, students should also have knowledge concerning the instruments of cooperation in criminal matters between the countries belonging to the European Union, in particular the European Arrest Warrant and the European Investigation Order. Students will be provided with competences enabling them to become familiar with the procedures initiated when a Polish authority is approached by an authority of another Member State with a request to act in a trial conducted by that authority, and initiated by a Polish authority making a similar request to an authority of another Member State. The module will also provide knowledge on EU offices facilitating cooperation between Member States' courts in civil and criminal matters and coordinating or conducting pre-trial proceedings in cross-border cases.
