Purpose and description of the content of education: | The "Non-litigious Proceedings" module aims to familiarize students with the theoretical foundations and principles of non-litigious proceedings as one of the procedural modes in civil law. The module presents the most significant institutions and procedures related to non-litigious proceedings, with particular emphasis on key regulations included in the Code of Civil Procedure.
Students will analyze, among other things, the principles of initiating, conducting, and resolving non-litigious cases, as well as the differences between litigious and non-litigious proceedings. The aim of the course is to deepen students’ understanding of the importance of non-litigious proceedings in the civil law system, with particular focus on the role of the court and participants in these cases.
The module includes an analysis of provisions governing non-litigious proceedings, including procedures related to inheritance matters, personal, property, and deposit law cases. Classes will also focus on presenting doctrinal views, interpretations of legal provisions, and court rulings, enabling students to understand the practical application of the law in non-litigious proceedings. |
