Purpose and description of the content of education:
The aim of the module is to familiarize the student with the institutions and principles of inheritance and family law. The student is to gain knowledge and acquire the ability to determine the consequences of the death of a natural person in the sphere of private law, as well as to gain knowledge of family law regulations, including in connection with the regulations of other areas of civil law. In addition to theoretical knowledge in the field of inheritance and family law, the student is also to obtain basic information on its use in court practice and in solving basic life problems. In the field of inheritance law, the following issues are discussed: the importance of inheritance law and its evolution after World War II, the concept of inheritance, inheritance titles, capacity to inherit, unworthiness, statutory inheritance, will - the concept, conditions of validity, freedom of testament, testamentary dispositions, compulsory portion, acceptance and rejection of inheritance, liability for inheritance debts, determination of rights to inheritance and its effects, division of inheritance, agreements concerning inheritance and succession. In the field of family law, the following issues are analyzed: the concept of family law and the specific features of family and legal relations, entering into marriage and its annulment, personal relations between spouses, marital property regimes, management of the spouses' joint property and their liability for debts, divorce, judicial and de facto separation, kinship and affinity, the child's origin and surname, determining motherhood and fatherhood, adoption and its types, relations between parents and children, parental authority, contact with the child, the obligation to pay maintenance and its implementation, care and guardianship.
