Purpose and description of the content of education: | The "Civil Law – Law of Obligations" module covers selected key issues from both the general and specific parts of the law of obligations. Its aim is to familiarize students with the law of obligations at a level exceeding basic knowledge of its principles and institutions. The knowledge gained in this course is also essential for understanding institutions of civil law addressed outside the scope of obligations law (property law, family law, inheritance law, and private international law).
The module is designed to introduce students to the fundamental institutions of the law of obligations. It includes, in particular, the following issues: the concept of obligation, sources of obligations, the concept and types of performance, debt and liability, contracts—their types, content, rules of performance, and consequences of non-performance of obligations—torts, unjust enrichment, causes of extinction of obligations, and changes in parties to the obligation.
The specific part of the obligations law includes statutory types of contracts and selected innominate (non-statutory) contracts. Typically, the course covers selected contracts from various categories, such as:
- contracts for the transfer of rights (e.g. sales contract),
- contracts for the use of things (e.g. lease, tenancy, and leasing contracts),
- contracts for the provision of services (e.g. mandate, agency, and commission contracts),
- licensing agreements and contracts for the transfer of proprietary copyrights,
- as well as partnership agreements, insurance contracts, suretyship and bank guarantee, and bill of exchange.
The lecture may also include basic information on securities and bearer documents. |
