Purpose and description of the content of education:
The content of the module is to present legal acts regulating proceedings in juvenile cases, principles of responsibility for acts covered by the Act on the Support and Resocialization of Minors, both in terms of the subject and the subject, as well as the conceptual framework relevant to this area. Students will also learn about the system of educational, corrective and therapeutic measures for juvenile delinquency, in comparison with penal measures for criminal responsibility. They will also learn about the basic factors contributing to the commission of criminal acts by juveniles from the perspective of criminology, as well as the differences characteristic of juvenile delinquency among girls. The basic principles regarding enforcement proceedings in juvenile cases are also considered. The second part of the lecture is a presentation of procedural issues concerning proceedings in juvenile cases. During the classes, three basic models of proceedings in juvenile cases will be presented first, i.e. the care model, the justice model and the model with elements of restorative justice. the basic features of these models will then be characterized in the context of the legal systems of the countries that adopted them, i.e. in the context of the legal solutions in force in the USA and in England and Wales. Polish proceedings in juvenile cases will be characterized from the perspective of these three model solutions. The analysis will also cover procedural guarantees available to minors, and their characterization will take place in the context of international and constitutional standards. These standards will also be discussed in the context of the provisions regulating temporary preventive measures applied to minors. Students will also be presented with the issues of statics and dynamics of proceedings in juvenile cases. Within this framework, evidentiary issues and participants in proceedings in cases of criminal acts and demoralization of minors will be analyzed. Considerations on the kinetics of the proceedings will cover court proceedings, the powers of the Police in the field of collecting evidence for the needs of the court, and the method of appealing against a judgment will also be described. The subject of analyses will also be the issue of the admissibility of challenging a final judgment by extraordinary means of appeal provided for in civil procedure, i.e. a cassation appeal, a motion to reopen the proceedings, a complaint for a declaration of illegality and an extraordinary complaint.
