Purpose and description of the content of education:
The task of the course is for students to acquire basic knowledge, skills and competencies in criminal law and the law of offenses. The student is to know the institutions of criminal law reconstructing the concept of crime and misdemeanor, the principles of responsibility for them. The student is supposed to have the ability to use theoretical knowledge, make subsumption of certain facts. The student is supposed to have the ability to distinguish between two regimes of responsibility and make an adequate choice between them. Upon completion of the course, the student should understand the relationship and interrelationships between “classical” criminal law and the law of misdemeanors. In particular, the student, in the course of study, is acquainted with the following issues: - The concept and principles of criminal law - Criminal law and its application; sources, interpretation, validity in terms of time, place and persons. - The concept of crime and its structure. - Forms of committing a crime; phenomenal and stadial. - Circumstances that exclude criminality; counter-crimes, lack of guilt, negligible social harm. - Convergence of crimes and provisions of the law. - The concept of punishment and the catalog of penalties and criminal measures. - Judicial imposition of punishment and modification of the sentence imposed. - Precautionary measures. - Statute of limitations and erasure of a criminal conviction. - The concept of a misdemeanor and its structure. - Circumstances excluding unlawfulness and guilt of a misdemeanor. - Forms of committing a misdemeanor (phenomenal and stadial) - Unity and multiplicity of offenses. Convergence of a misdemeanor with a felony - Penalties and punitive measures in the law of misdemeanors - Principles of assessing punishment for misdemeanors - Statute of limitations and erasure of misdemeanor convictions
